NHRC fines UP govt for custodial death

The National Human Rights Commission has directed the Uttar Pradesh government to pay a sum of Rs 200,000 to the next of kin of an undertrial who died in custody in Lucknow district.

NHRC sources said on Tuesday that the Commission asked the state government to initiate action for identification of the officials responsible for causing injuries to the victim, Jagdish, and register a case against them.

Earlier, taking cognizance of an intimation sent by the superintendent of district jail, Lucknow, about the death of Jagdish, a resident of Paschim village, coming under Madiyar police station, on the night of January 17, 1997, in the Medical College Hospital, Lucknow where he was taken for medical treatment, the Commission had issued notice to the state home secretary for a detailed report on the matter.

The report stated that Jagdish was admitted to the district jail, Lucknow on January 17, at about 1700 hours (IST) with a number of bleeding injuries on his person. The jail superintendent got him examined through a pharmacist as there was no medical officer available.

It was disclosed that Jagdish was medically examined at the primary health centre the same day and six injuries, received in the last 12 hours, were found on his person.

At about 1800 hours, he became restless and began crying on account of the pain. He was knocking his head and even vomited. So, he was taken to the Medical College Hospital and admitted to the emergency ward.

Later, he was referred to the surgical ward but breathed his last, at about 2245 hours, while being taken there.
