HC orders Mendonca's reinstatement

Mendonca was unceremoniously transferred as managing director of the Maharashtra State Police Housing and Welfare Corporation, manifestly a less important post, by the state government.

The bench, comprising A P Shah and P V Kakade also set aside the Central Administrative Tribunal and state government order, according to which Mendonca was transferred to the police housing department.

The bench, however, also stayed the operation of its order for four weeks to enable the state government to challenge it in the apex court.

Earlier in the day, the bench came down heavily on the state government and observed that the CAT order was obtained by collusion between respondent S Iyenger and the government without giving notice to the petitioner, Mendonca. The bench also observed that there was no satisfactory explanation from the state to have hidden the vital fact before the tribunal.

Mendonca was unceremoniously removed from the Anti-Corruption Bureau by the Democratic Front Government after seven months, during which he had conducted a crusade against corruption, which had unsettled corrupt public servants and politicians. Despite his track record, Mendonca was moved out of the ACB on November 21 and posted as managing director of the Maharashtra State Police Housing and Welfare Corporation.
