Court orders compensation for victims of failed vasectomy

The Allahabad high court on Wednesday directed the Uttar Pradesh government to pay a compensation of Rs 100,000 to a woman and Rs 50,000 to her son who was born after her husband had undergone a 'vasectomy operation' at the district hospital, Sitapur, on November 4, 1989.

The court passed the orders on a writ petition filed by Shakuntala Sharma and her minor son, who was born on January 1,1991. Shankuntala's husband, Ghanshyam Sharma, had undergone a vasectomy operation, which was carried out by Dr Zaheer Hasan of the district hospital, Sitapur.

Shakuntala Sharma in her petition mentioned that following the birth of the child after the operation, her reputation of a devoted Hindu wife became suspect and she was tortured by the remarks of her husband, neighbours and relatives.

When the semen of her husband was examined after great persuasion by her, it was discovered that 60 per cent spermatazoa were present, the petitioner said.

The high court, which awarded the amount of Rs 1 lakh to Shakuntala Sharma for her mental agony, directed that Rs 50,000 be placed in fixed deposit in her son's name for expenditure on food, clothing and education till he attains majority.
