Sessions Judge M S Keni on Tuesday put off a decision on actor Fardeen Khan's bail application to Thursday, May 10.
Khan was arrested by the Narcotics Control Bureau in the wee hours of Saturday while in the act of buying cocaine, and has been charged under the Narcotics, Drugs and Psychotropic Substances Act.
Moving the bail application on Tuesday, Fardeen's lawyer Ayaz Khan argued that the actor was not found consuming but merely acquiring one gram of the drug.
Ayaz Khan emphasised on the small quantity to show that Fardeen was buying it for his personal consumption and not to trade in the substance. Besides, he pointed out that the transaction had not been completed as Fardeen could not draw money from the Automatic Teller Machine after his card got stuck in it.
Fardeen was only a potential customer and the contraband was in Naseer's custody, the court was told, and hadn't been passed on to the actor.
"He is a film actor, just settling down. He can't be said to be a drug peddler. If given bail he will not tamper with evidence," the defence lawyer told the court.
"People make mistakes, give him a chance," Ayaz pleaded to which the judge said, "You are now appealing to my heart."
Public Prosecutor Usha Sisodiya said the fact that drugs were found in Fardeen's car showed that he was in possession of them, and that he was not a mere consumer.
The two sides also argued on the section of the NDPS which would apply in this case.
The arguments began at 1445 hours (IST) and ended at 1615 hours, when the judge said he would announce his decision on Thursday.
Neither Fardeen, nor his father Feroz Khan was present in the court.
